The following questionnaire (Pre-Qualification Submission Form), dated January 2008, has been issued by Iraq’s Ministry of Oil for companies wishing to qualify for oilfield development contracts in the country.

1- Legal Qualification
Required documents:
1.1. Establishment documents, which should contain:
a- Company name and type, public or private; (national, international, holding, limited, incorporated or stock company);
b- Locations of headquarters and all branches;
c- Proper establishment and continued legal registration;
d- Statement of outsource financial support, if any;
e- Company’s by-laws;
f- Certified copy of its Charter/Articles of Incorporation.
1.2. Tax record, which should contain the following:
a- List of locations (countries) where or where not the company or its affiliates is subject to tax.
b- Certificate of a (quittance) from tax authorities where the company or its affiliates is subject to tax.
c- A certificate showing that the company did not violate tax regime in any manner; the tax authority, where the company is subject to tax, should certify this document.
1.3. Legal record, which should contain the following:
a- Number and types of legal cases, which had been raised and contested by the company; at which courts; and the results of these cases;
b- Number and types of legal cases, which had been raised and contested against the company, at which courts, and the results of these cases;
c- Number, types and reasons of arbitration cases the company was involved in; name of arbitration authority and the results of arbitration.
1.4. Previous work record, which should also contain the following:
a- A list and details of uncompleted work obligations (country, type of contract, date and duration of contract, contract current status, reasons behind the situation).
2- Financial Qualification
Required documents:
2.1. Certified consolidated financial statements (balance sheets and income statement) audited by a legal independent auditor for the past two years. In addition, unaudited consolidated financial statements for the most recent quarter.
2.2. Current and historical credit rating (by specialized consultant and experienced firms and /or authorities).
2.3. Financial strength evidence.
2.4. Magnitude and locations of upstream capital investment for each of the last five years.
2.5. Any additional information, which can support investing capabilities status.
3-Technical Qualification
Required documents:
3.1- A list of upstream projects for the last five years, which should indicate (on project base):
a- The company status in such project (operator or not);
b- Gross production rate and oil equivalent reserves.
3.2- Annual average investment in upstream research activities over the last five years.
3.3- Industry recognition award for technical excellence or
3.4- Qualitative evaluation of experience in technical, economical, and environmental challenges, which will depend on the information provided by the company as, follows:
a- Working in complex geological and stratagraphic environment; give examples;
b- Working in abnormal conditions especially in drilling and production; give examples;
c- Working on naturally fractured reservoirs during drilling or production; give examples;
d- Working on small or marginal fields; give examples;
e- Working on complex or thin reservoirs; give examples;
f- Working on heavy oil reservoirs (less than 20° API); give examples;
g- Working on tail-end production cases; give examples;
h- Working with sour gases (CO2, H2S) crude oil reservoirs; give examples;
i- Project management, implementation (event timing, budget allocation, decision making during critical conditions and management organization);
j- Adopting optimum technical solutions in complex and smart completion operations and complex surface facilities.
4- Training and Development Qualification
Required documents:
4.1- Training courses the company organized for their employees as an annual average over the last five years.
4.2- Number of Company personnel as lecturers in training and development courses over the last five years.
4.3- Training courses which the company organized for the Ministry of Oil personnel over the last 5 years, if any.
4.4- Post graduate seats (MSc, PHD) offered at international universities or institutions, for the Ministry of Oil personnel, if any.
5- HSE Qualification
Required documents:
5.1- HSE policy approved by the Company management.
5.2- Relevant documents of application and annual review of HSE policy approved by the management.
5.3- HSE application according to well recognized standards during the last three years.
5.4- Relevant documents of evaluation regarding application levels of HSE plans.
5.5- Relevant documents of the management capabilities to generate effective HSE plans depending on work site environment.
5.6- Relevant documents of adopted emergency plans and their application procedures.
5.7- Relevant documents of incidents and management procedures.
5.8- Relevant documents of HSE training and orientation programs for employees and contracted/ subcontracted workers.
5.9- Relevant documents of organization structure which includes stipulated responsibilities for HSE plans.
5.10- Relevant documents of the company process to qualify, select and monitor contractors with respect to HSE compliance.
5.11- The following information over the last five years:
a- Number of human incidents, their causes and treatments.
b- Number of facilities, equipment and devices defections, their causes and treatments.
c- Number of well blowouts during drilling; their causes and treatment.
d- Number of well blowouts during production, their causes and treatment.
e- Number of leakage incidents in surface facilities, their causes and treatment.
f- Number of subsurface-cross-flow between formations, their causes and treatment.
g- Number of natural environment pollution accidents (inland, air and sea) their causes and treatment.
h- Number of fire accidents, their causes and treatment.
